Signing with a Witness
Certain documents such as a Deed, or a Will require a Signature to be independently witnessed.
SignatureSense can facilite this by sending a signature request to the appointed witness.
Appointing a Witness
If a signatory is marked as "witness required," SignatureSense will ask the Signatory to provide the name and email address of their witness before they sign. Once the Signatory has completed their signature, the Witness will be emailed their own unique link to attest that they witnessed the signing.
Physical Presence Requirements
Under UK law, a witness must be in the same physical room as the person signing. This requirement remains strict even when using digital platforms like SignatureSense.
It is a common misconception that observing a signature via a video call (such as Zoom, Teams, or FaceTime) is legally sufficient. To ensure the document is valid:
The witness must have a clear, head-on view of the signatory as they click to sign.
The witness should then immediately check their own email to sign the attestation.
SignatureSense provides the platform for this process but cannot physically enforce co-location. It is the responsibility of the document sender and signatory to ensure that the Signatory and the Witness are in the same physical location at the time of signing.
